Michael Sussman 10/2/01 Federal Bureau of Investigation Kim Crowell Investigator 135 Pinelawn Road Suite 350 South Melville, N.Y. 11747 To whom it may concern: On or about September 30, 2001 I spoke via telephone to Special Agent Daniel P. Brennan. Special Agent Brennan stated that he wished to speak to me pertaining to a purchase of equipment which I made and the World Trade incident. Special Agent Brennan stated that he "wanted to show me something". He could not describe it to me while I was on the phone with him, nor could he tell me what type of equipment was involved, but it was very important and urgent that he meet with me ASAP. In an effort to assist the Federal Bureau of Investigation, I agreed to meet with Special Agent Daniel P. Brennan. I informed the agent I would be available about 11 p.m. and received a response that he gets off work at 6 p.m. I do not understand how this can be such an important issue until the quitting bell rings, considering the circumstances! On October 2, 2001, I met Special Agent Daniel P. Brennan and Special Agent William Falcone. The agents became hostile and refused to advise me of the nature and subject matter of their interview. The agents advised me that they would obtain a grand jury subpoena. In light of the above, and because it appears that the agents refused to act in a professional manner, I must invoke my right to counsel. No agent of the Federal Bureau of Investigation or any Justice Department component are to contact me without first appointing counsel. In the event that a grand jury subpoena is served, I request counsel to be appointed to advise me with respect to the subpoena and what is required of me. I invoke all Constitutional Protections including those found in the Fifth and Sixth Amendments to the United States Constitution. I reiterate that this invocation of rights is necessary only because the agents appeared to be deceptive in their mannerism and would not reveal the nature of their interview.
